| Any help or info, car got hit!!! So Im on the post road Route 1 in my town in the left lane. Someone pulls out from the right and sideswipes my car big time. My front quarter, door, and rear quarter all need to be replaced.
Best part is the person driving didnt own the car, the passenger did. Why, you ask, well the passenger/owner had a suspended license, no big deal she isnt driving right? Maybe, if she had insurance. 2003 Toyota Celica, black and she cancelled her insurance in April cause of the suspension.
So I am basically going to screw her for all that I can get. My deductible is 1k and I really dont wanna pay it. Anyone know if I can go after the driver's insurance in CT. I am just so mad, I called my insurance, made a claim, then called her insurance to make one, then found out about the cancellation. My agent then called the driver and found that she was suspended. I have the local police and they issued a summons so she has a court appearance for this. I swear she is gonna pay for the car and then some if I can. GRRRRRRRR!!!!
Basically if I see another Celica they have a death wish, no Celica will ever pass, be near, or anything ever again. Anyways, just thought I would inform you all, later. |

| Well you can win a court case all day long against the girl, but making her pay is another issue. You most likely will never see a penny, but good luck.

| good luck to you, sir. That's a hard bit to swallow. I hate people w/ no insurance/license that still drive...what's to happen to the dip**** other driver (the one that actually did the sideswiping)?

| Well my gf's father is a state lawyer and is drafting up a letter for me to send to the states attorney office of my town. When she goes to court the judge will make her first pay for the deductible, then the insurance will go after her for the rest. If she does not pay it will spell possible jail time until she does because of the offense of uninsured. I am in the process of finding out if the driver can be liable since you can have a policy in CT that allows you to be covered by your own insurance no matter what car you drive so we shall see how that turns out.
I would like to say more about stuff but I dont want anything to be found and used against me if anything else develops. |

| Goode luck Whelan. I hope you get this resolved. I have been in the same boat about 3 or 4 times. I got hit by a drunk driver that was uninsured. Luckily it was a saturn so it only needed to be repainted  Because I was on office time doing a field visit, my boss paid the deductible for me ($500) I never heard back from the law or insurance company. That was 6-7 years ago.

| Last I checked you don't need to pay a deducitble if you got hit. Only if you did the hitting. If she has no insurance your company should still pay in full, cuz you weren't at fault. And if all else fails, sue her and the driver.

I called the police, a state trooper showed up,she told the trooper she had insurance and so did I,he ran a check on both of us and found out she didn't have insurance, Her license was suspended and the cars stickers were out of date, he was pissed that she lied to him.
He wrote her five or 6 tickets, basically through the book at her.
She went to jail, the car was impounded, her pasenger had to walk home and my insurance had to pay for my cars repairs, no money out of my pocket at all.
All of this and she didn't have a job to pay for anything.  |

| your insurance should cover it, they will go for the full amount out of her because the insurance she should have had, was supposed to cover it.
